AG Granted Leave to Appeal Over Najib’s Controversial Document Case

Kuala Lumpur: The Federal Court here today granted leave to the Attorney-General (AG) to appeal against the existence of an additional document in the case involving former Prime Minister Datuk Seri Najib Tun Razak.

According to BERNAMA News Agency, a three-judge panel led by Chief Judge of Malaya Datuk Seri Hasnah Mohammed Hashim, in a unanimous decision, stated that the proposed questions raised by the AG met the threshold requirements for leave to be granted under Section 96 of the Courts of Judicature Act (CJA) 1964. The Apex Court has scheduled the hearing of the appeal for July 1 and 2.

The panel also included Federal Court judges Datuk Zabariah Mohd Yusof and Datuk Hanipah Farikullah. The AG, acting as the applicant, had filed the leave application challenging the Court of Appeal's ruling. It is mandatory for an applicant to obtain leave to proceed with an appeal to the Federal Court.

The appeal stems from a decision on January 6, where, in a 2-1 majority, the Court of Appeal remitted Najib's case concerning the existence of an additional document, which allegedly permitted him to serve the remainder of his six-year prison sentence under house arrest, back to the High Court to be assessed on its merits. This decision had overturned the High Court's earlier ruling dismissing Najib's application for leave to commence a judicial review regarding the said document.
