Kuala lumpur: The Court of Appeal has dismissed the appeal by Tan Sri M. Kayveas, who sought to challenge the appointment of Datuk Seri Maglin Dennis D'Cruz as the president of the People's Progressive Party (myPPP). This decision follows the High Court's prior refusal to grant Kayveas leave for a judicial review.

According to BERNAMA News Agency, the verdict was delivered by a three-judge panel consisting of Justices Datuk Lim Chong Fong, Datuk Dr Lim Hock Leng, and Datuk Ahmad Shahrir Mohd Salleh. Lawyers Gavin Jayapal, representing myPPP's public officer Datuk Dr Loga Bala Mohan, and M. Manoharan, representing Kayveas, confirmed the court's decision.

Justice Lim Hock Leng, delivering the panel's unanimous decision, stated that the High Court was correct in its judgment that the matter was non-justiciable, as per Section 18C of the Societies Act. He noted that Kayveas's status as a non-member rendered the issue academic and emphasized that the application was frivolous and did not meet the criteria to proceed with judicial review.

The High Court had previously dismissed Kayveas's application on November 20, 2023, which sought to overturn a decision by Badrul Hisham Alias of the National Registration and Societies Division regarding the revocation of myPPP's de-registration. The party had been deregistered on January 14, 2019, due to internal disputes.

Kayveas also aimed to nullify the party's Annual General Meeting held on March 19, 2023, where D'Cruz was appointed president. Dr Loga Bala was represented by lawyer Parveena Kaur, while senior federal counsel Nurhafizza Azizan and federal counsel Muhammad Muhairi Mohamed Noh appeared for the minister. Lawyers M. Manoharan and Ganendra Manoharan represented Kayveas in the proceedings.
