Child Sexual Misconduct and Grooming Under Review in Malaysian Child Act Amendment

Kuala Lumpur:The Ministry of Women, Family and Community Development is evaluating amendments to the Child Act 2001 to address sexual misconduct involving children, focusing on predation and peer-to-peer grooming.

According to BERNAMA News Agency, Minister Datuk Seri Nancy Shukri highlighted the importance of carefully refining legal provisions to prevent unintended consequences for those involved. She referred to a recent case where a teenager, aged 13, was arrested for producing child sexual abuse material during 'Op Pedo 3.0'.

Nancy emphasized that while actions by minors sometimes exceed typical behavior, the legal framework must avoid double jeopardy. She stated this during the National Reproductive Health Symposium 2026, also noting that the amendment bill's drafting process is thorough, incorporating input from stakeholders to ensure comprehensiveness.

The Royal Malaysia Police reported the involvement of children in creating explicit animated content, with eight youths aged 13 to 18 detained in a joint operation with the Malaysian Communications and Multimedia Commission. Investigations revealed some suspects produced and distributed their own material online.

On July 21, Nancy mentioned that amendments are being reviewed based on 159 recommendations from the United Nations Committee on the Rights of the Child. These recommendations aim to enhance the legal framework, safeguard against abuse, and ensure a comprehensive implementation of children's rights.
