Company Director and Father Charged with Submitting False Documents in MADA Tender

Kota Setar:A company director faced charges today for allegedly submitting false documents in a tender application to the Muda Agricultural Development Authority (MADA) earlier this year. His father, also the managing director of the company, was charged with abetting him.

According to BERNAMA News Agency, Muhammad Fadzil Md Fadzilah, 30, and his father, Md Fadzillah Ariffin, 66, both pleaded not guilty to the charges, which were presented separately before Judge N Priscilla Hemamalini.

Muhammad Fadzil, director of Taaveekun Manufacturing Sdn Bhd, is accused of providing a document entitled 'Financial Data (Document No. 11)' containing false financial details to an agent who was the chairman of MADA's Tender Opening Committee. The document falsely claimed eligibility for a RM7 million fixed loan, an RM8 million Letter of Credit, and a RM15 million Insurance Guarantee from Permodalan RISDA Berhad.

The alleged offence took place at MADA's Kota Setar district office on January 11, under Section 18 of the Malaysian Anti-Corruption Commission (MACC) Act 2009. This charge carries a potential sentence of up to 20 years in jail and a fine of no less than five times the value of the false particulars or RM10,000, whichever is greater.

Additionally, Muhammad Fadzil was charged with using a purportedly false document, a letter from the Rubber Industry Smallholders Development Authority (RISDA) dated January 6, 2026. This was attached to a tender application for supplying padi fertiliser for the 2026 crop seasons, on January 11 at MADA Kota Setar. This charge was framed under Section 471 of the Penal Code, which allows for a jail term of up to two years, a fine, or both.

Md Fadzillah faces two charges of abetting these offences under Section 28(1)(c) of the MACC Act 2009, in conjunction with Sections 18 and 471.

The court granted bail to both Muhammad Fadzil and his father at RM20,000 each, with one surety per charge, and set November 1 for mention.

The prosecution was led by MACC Deputy Public Prosecutor M Kalaivaanan, while the accused were represented by lawyer Fahmi Adilah. It was previously reported by the media that MACC Kedah had detained a managing director of a fertiliser supply company over delayed fertiliser distribution to padi farmers in Kedah.
