Company Secretary Faces Charges for False Financial Reporting to SSM

Kuala lumpur: A company secretary, Mohd Khairul Amini A. Ramli, pleaded not guilty today at the Sessions Court to charges of submitting false financial statements to the Companies Commission of Malaysia (SSM) three years ago. The allegations pertain to inaccuracies in the 'Financial Report and Statements for the Year Ended 31 December 2022' of Xperanti IOT (M) Sdn Bhd.

According to BERNAMA News Agency, Mohd Khairul is accused of making false statements regarding the circulation of financial statements to company members on November 28, 2023. The statements were allegedly not circulated as claimed. The charge was filed for actions purportedly taken at Menara SSM@Sentral, KL Sentral, on November 29, 2023. If found guilty under Section 593(b) of the Companies Act 2016, Mohd Khairul could face a sentence of up to 10 years imprisonment, a fine of up to RM3 million, or both.

Judge Siti Shakirah Mohtarudin granted bail set at RM10,000 and scheduled the next mention of the case for February 12. The prosecution was led by SSM officer Farieza Hazreen Salehuddin, while the defense was managed by lawyer Muhammad Amir Akmal Ahmad Shukri.
