Court of Appeal Set to Hear Najib’s House Arrest Appeal

KUALA LUMPUR: The Court of Appeal is scheduled to hear Datuk Seri Najib Tun Razak's appeal tomorrow regarding the rejection of his request to serve the remainder of his six-year prison term under house arrest. This appeal is based on his assertion of a royal addendum that allegedly supports his claim. According to BERNAMA News Agency, the hearing, originally slated for December 5 of last year, will begin at 9 a.m. before a three-judge panel consisting of Justices Datuk Azizah Nawawi, Datuk Azhahari Kamal Ramli, and Datuk Seri Mohd Firuz Jaffril. Additionally, the court will address Najib's motion to introduce new evidence in support of his claim of the addendum's existence. The proceedings were postponed to January 6 after Tan Sri Muhammad Shafee Abdullah, Najib's attorney, informed a three-judge panel of his application filed on December 3 of the previous year to submit further evidence. Najib, aged 71, is contesting the Kuala Lumpur High Court's decision from July 3 last year, which dismissed his request for a judicial review of an alleged addendum issued by the 16th Yang di-Pertuan Agong. He alleges that the addendum would allow him to complete his sentence under house arrest. High Court Judge Datuk Amarjeet Singh determined that the affidavits supporting Najib's claim, including those from UMNO president Datuk Seri Dr Ahmad Zahid Hamidi and vice-president Datuk Seri Wan Rosdy Wan Ismail, were considered hearsay and inadmissible. Najib is seeking a mandamus order to compel the respondents to confirm and verify the existence of the purported decree dated January 29, 2024. The respondents in the case include the Malaysian Government, the Home Minister, the Commissioner-General of Prisons, the Attorney-General, the Pardons Board for the Federal Territories of Kuala Lumpur, Labuan, and Putrajaya, the Minister in the Prime Minister's Department (Law and Institutional Reform), and the Director-General of Legal Affairs Division at JPM. Najib is also requesting that if the decree is confirmed, the respondents must enforce it, facilitating his transfer from Kajang Prison to his residence in Kuala Lumpur to serve his remaining sentence under house arrest. Najib is serving a six-year prison sentence after being found guilty of embezzling RM42 million from SRC International Sdn Bhd. The High Court initially sentenced him to 12 years and fined him RM210 million, a decision later upheld by the Court of Appeal and Federal Court. However, his prison term was reduced to six years, and his fine lowered to RM50 million following a royal pardon petition on September 2, 2022.
