KPKT to Introduce Comprehensive Real Property Development Bill by June 2026

Kuala lumpur: The Ministry of Housing and Local Government (KPKT) is set to introduce the Real Property Development Bill in June 2026, replacing the existing Housing Development (Control and Licensing) Act 1966 (Act 118), as announced by Minister Nga Kor Ming. The new bill is designed to create a modern and responsive regulatory framework to enhance the protection of homebuyers.

According to BERNAMA News Agency, the Real Property Development Bill aims to expand regulatory oversight beyond residential developments to include commercial projects, while updating legal provisions to reflect current market demands and land types. During the MADANI Housing Reform event, where National Housing Department director-general Datuk N Jayaselan was present, Nga emphasized the need for a modern and flexible legislative framework that can adapt to industry changes.

The bill is part of five key reforms expected from the Ministry by 2026, which include the electronic Sales and Purchase Agreement (eSPA), Housing Integrated Management System (HIMS), Transforming and Empowering Data Usage in Housing (TEDUH), and audits for Housing Development Accounts. Key proposals under the bill focus on standardizing penalties for serious and repeat offences, enhancing buyer protection, and establishing clearer technical audit and investigation powers to identify troubled projects earlier.

Nga highlighted that the bill will ensure housing projects in Malaysia operate within a structured and transparent ecosystem, aligning with Malaysia MADANI's aspirations and the structural reform of the housing sector. The eSPA will offer digital signing, secure identity verification, and integration with the Inland Revenue Board's eStamping system, simplifying the process and potentially increasing government revenue by up to RM8 billion if implemented successfully next year.
