Kuala lumpur: The Malaysian Communications and Multimedia Commission (MCMC) today commenced the Public Consultation on the Proposed Regulatory Framework for Retention, Preservation, and Disclosure of Communications Data for Investigation Purposes (Proposed Regulatory Framework).
According to BERNAMA News Agency, the initiative follows recent amendments to the Communications and Multimedia Act 1998 (CMA 1998), with the introduction of sections 252A, 252B, and 268A, which came into force in February. These new provisions establish a legislative basis for the retention, preservation, and disclosure of communications data to support criminal investigations.
The MCMC highlighted the increasing frequency and complexity of online threats such as scams, fraud, cyberbullying, and harassment. It emphasized the importance of law enforcement agencies having timely access to accurate data to assist in investigations, which is crucial for public safety and national security.
The Proposed Regulatory Framework aims to enhance the investigative capabilities of law enforcement agencies and provide clear legal and operational guidance for service providers. It also seeks to protect individual privacy through defined safeguards and due process.
The MCMC has encouraged industry players, civil society, and the general public to participate in the consultation process, which will be open until August 8. This consultation offers a chance for stakeholders to provide feedback and contribute to a regulatory framework that balances national enforcement needs with global data protection standards.
