MCMC Maintains Regulatory Authority Under New Online Safety Legislation

Kuala lumpur: The establishment of the Online Safety Committee will not affect the Malaysian Communications and Multimedia Commission's (MCMC) role as the primary regulator under the Online Safety Act 2025 (Act 866), according to Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said.

According to BERNAMA News Agency, Act 866 enhances MCMC's mandate, empowering it to lead investigations and enforcement against platforms that do not adequately protect users. Azalina stated that MCMC's regulatory powers remain unchanged, with the committee providing strategic analysis, technical data, and expert input to aid regulatory decisions. The checks-and-balances mechanism is designed to ensure transparency and evidence-based decision-making without compromising freedom of expression.

The Pro Tem Committee, chaired by Azalina at the Asian International Arbitration Centre (AIAC), serves as a coordinating and advisory platform. It identifies online risks, offers technical input, and makes policy recommendations to inform regulatory decisions. The committee is also tasked with conducting technical studies, expert analyses, and coordinating consultations with various stakeholders to submit policy proposals to regulators and policymakers.

Azalina highlighted that before the full enforcement of the Act, the Pro Tem Committee's role includes setting strategic directions, policy priorities, and governance frameworks to ensure smooth implementation. Once the Act is enforced, the committee will be chaired by former Chief Judge of Malaya Tan Sri Hasnah Mohammed Hashim.

During the meeting, AI-related threats, such as deepfakes, were discussed, along with the committee's draft Terms of Reference (ToR). Engagement sessions were held with ministries, agencies, and civil society representatives, including Article 19 and the Centre for Independent Journalism (CIJ).

The Minister emphasized the MADANI Government's commitment to building a safe digital ecosystem. The Legal Affairs Division (BHEUU) will continue to strengthen the legal framework in line with global technological advancements while balancing freedom of expression, legal responsibility, and public interest.
