Kangar: Perlis state assembly Speaker Rus'sele Eizan has initiated legal action to strike out an originating summons filed by three former state assemblymen at the Kangar High Court. The move is part of an ongoing legal battle concerning the declaration of casual vacancies in the state assembly seats they formerly held.
According to BERNAMA News Agency, the lawyer representing Rus'sele, Wan Rohimi Wan Daud, confirmed that the application to strike out the summons was filed on Monday. The case management of the summons was conducted via Zoom before Kangar High Court judge Datuk Mohamad Abazafree Mohd Abbas. The court has set March 25 as the deadline for the plaintiffs to respond to Rus'sele's affidavit, with April 15 slated for the defendant's further reply. A Zoom proceeding has been scheduled for April 16 to determine the hearing of the application and related instructions.
The legal conflict began on January 2, when former state assemblymen Mohd Ridzuan Hashim (Guar Sanji), Fakhrul Anwar Ismail (Bintong), and Saad Seman (Chuping) filed the summons against Rus'sele. The summons challenges Rus'sele's declaration of casual vacancies in their respective seats following their cessation as PAS assemblymen.
Rus'sele's announcement on December 25 last year declared the vacancies in the Chuping, Bintong, and Guar Sanji seats, citing Clause (1)(a)(ii) of Article 50A of the Perlis State Constitution. This decision followed a statement from PAS president Tan Sri Abdul Hadi Awang on December 24, which stated that the assemblymen's memberships had ceased under Clause 76 and Clause 15A(1)(b) of the PAS Constitution (Amendment 2025).
