College Student’s Appeal to Dismiss Murder Charge Over Fatal Collision Rejected

Kuala Lumpur:A college student's attempt to have a murder charge dismissed in connection with the deaths of a married couple in a collision on Jalan Ampang near Great Eastern Mall has been unsuccessful. This decision was made four months after the incident.

According to BERNAMA News Agency, High Court Judge Datuk Aslam Zainuddin ruled against Danish Raman Kamar Kumaresan's application to strike out the murder charge. The decision came after the prosecution's preliminary objection to the application was upheld.

The proceedings were attended by Deputy Public Prosecutor Mohamad Fadhly Mohd Zamry and defense lawyer Donald Selvam. The prosecution argued that the application was irregular and did not comply with the Courts of Judicature Act 1964.

Danish Raman, aged 24, argued that the charge under Section 302 of the Penal Code was made in bad faith and breached Articles 5 and 8 of the Federal Constitution. He was charged with the murder of A. Doraisingam and A. Menagah, who died from severe head injuries after their motorcycle was hit by a Toyota Vios driven by him on May 2.

Section 302 of the Penal Code stipulates severe penalties, including the death penalty or imprisonment of between 30 and 40 years and a minimum of 12 strokes of the cane upon conviction.
