Kuala lumpur: The Department of Islamic Development Malaysia (Jakim) is conducting an in-depth review of the draft Islamic Family Law (Federal Territories) Bill, which includes assessing whether the provisions on the maintenance (nafkah) of infirm parents should be refined. Minister in the Prime Minister's Department (Religious Affairs) Datuk Dr Mohd Na'im Mokhtar said the bill is expected to be tabled in Parliament in March next year.
According to BERNAMA News Agency, the comprehensive review aims to ensure the provisions align with the principles of Islamic law and address the current realities of the Muslim community in the country. Dr Mohd Na'im emphasized that the review allows the government to evaluate whether existing provisions are sufficient or require further scrutiny. The draft laws are actively being prepared through legal scrutiny, stakeholder engagement, and technical review to meet community needs and align with Islamic law principles.
During the Minister's Question Time at the Dewan Rakyat, Dr Mohd Na'im responded to Aminolhuda Hassan (PH-Sri Gading) regarding measures to improve Islamic family law provisions. These improvements include making it mandatory for children to support their parents, particularly when they are infirm, without income, or unable to support themselves. Additionally, the government, in collaboration with the Department of Syariah Judiciary Malaysia, is working on the Syariah Court Bill. This bill aims to include clearer provisions on parental care and maintenance, ensuring that the Syariah court can effectively handle claims relating to the welfare of infirm or incapacitated parents.
Engagement sessions with stakeholders are being held to gather detailed information, address practical field issues, and ensure that the proposed provisions are practical and implementable. Through this process, Jakim seeks to evaluate, coordinate, and draft a model law that can serve as a reference for states. This approach aims to ensure greater uniformity in the implementation, interpretation, and practice of the Syariah courts nationwide.
