Man Fined RM6,000 For Using Daughter’s Birth Certificate For MyKad Application

Kuantan: A man was fined RM6,000 by the Magistrate's Court here today for knowingly submitting false information in an application for an identity card or MyKad. Magistrate Tengku Eliana Tuan Kamaruzaman imposed the fine on Abdah Said, 65, after he pleaded guilty to the charge. He promptly paid the fine.

According to BERNAMA News Agency, Abdah was charged with providing false information by using a birth certificate issued in the name of another child while applying for an identity card for a 12-year-old girl. The offence took place at a counter of the Pahang National Registration Department (NRD) at 9.49 am on September 28, 2012.

The offence falls under Regulation 25(1)(b) of the National Registration Regulations 1990 (Amendment 2007), which allows for a maximum jail term of three years, a fine not exceeding RM20,000, or both, if convicted. The prosecution was led by NRD Prosecuting Officer Mohammad Yusaini Yunan and Assistant Prosecuting Officer Burhanuddin Hamzah, while the accused did not have legal representation.

In his plea for leniency, Abdah cited unemployment as a mitigating factor. However, Mohammad Yusaini argued for a severe and proportionate punishment, emphasizing the seriousness of the offence. He highlighted that the accused had used his own daughter's documents for personal gain, and stressed that the punishment should serve as a deterrent to others from handing over documents belonging to Malaysian citizens to foreigners, which could enable them to enjoy privileges meant for Malaysians.
